2. How to Submit a DMCA Takedown Notice

If you believe that material hosted on GFXToolz infringes your copyright, you must send us a valid DMCA takedown notice. To submit a DMCA notice, please send an email to [email protected] with a CC to [email protected], and include the following information:

• Your name, address, telephone number, and email address (so we can contact you about the matter).
• A description of the copyrighted work that you claim has been infringed.
• The URL or location of the material that you believe is infringing your copyright.

• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
• Your electronic or physical signature.

Once we receive your DMCA notice, we will take action in accordance with the DMCA and review the material in question.

3. GFXToolz Response to DMCA Takedown Notices

Upon receipt of a valid DMCA notice, GFXToolz will take the following steps:

• We will remove or disable access to the material that is claimed to be infringing.
• We will notify the user or account holder responsible for the allegedly infringing content of the takedown request.
• We will provide the party responsible for the content with the opportunity to submit a counter-notice, as outlined below, if they believe the takedown request was made in error or is misidentifying their content.

4. Counter-Notice Procedure

If you believe that the material that was removed or disabled as a result of a DMCA takedown notice was removed in error or due to misidentification, you may submit a counter-notice to GFXToolz. The counter-notice must include:

• Your name, address, telephone number, and email address.
• A description of the material that has been removed or disabled and the location where the material appeared before it was removed or disabled.
• A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
• Your physical or electronic signature.
• A statement that you consent to the jurisdiction of the federal court in your judicial district and that you will accept service of process from the person who provided the original DMCA notice or an agent of that person.

Upon receipt of a valid counter-notice, GFXToolz will forward the counter-notice to the person or entity who submitted the original DMCA takedown request. If they do not file a lawsuit against you within 10 business days, we will restore the removed content.

5. Fair Use and Subscription Sharing

Many tools and services provided on GFXToolz are accessed under shared subscription models, and we understand that some tools’ Terms of Service (TOS) may not explicitly permit subscription sharing. However, all subscriptions and licenses offered on our platform are legally obtained, and we respect the rights of tool providers. If any tool or service provider believes that subscription sharing violates their copyright or Terms of Service, they may submit a DMCA notice.

We will promptly address any such concerns and take appropriate action, including removing or disabling access to the service if the claim is valid and verified. Please note, we comply with all legal regulations and do not tolerate unauthorized use of copyrighted material.

6. No Liability for User Actions

GFXToolz provides a platform for users to access third-party tools and resources. We do not control or assume liability for the content users upload, share, or access. However, we take copyright infringement claims seriously and will respond to all DMCA notices as outlined above. Users are solely responsible for ensuring that they comply with all copyright laws when using GFXToolz services.

7. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, GFXToolz has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We reserve the right to terminate user accounts and access to the GFXToolz platform for repeat copyright violations.

8. False DMCA Notices

Submitting false or fraudulent DMCA notices can result in legal consequences, including penalties for perjury. If you are unsure whether the material in question is infringing, we recommend seeking legal advice before submitting a notice. GFXToolz will not tolerate abuse of the DMCA process and may take legal action against individuals who submit fraudulent claims.
